AGREEMENT TO OUR LEGAL TERMS

We are Wheat Ridge Community Chorale, doing business as Foothills Community Choir (“Company,” “we,” “us,” “our”), a non-profit organization registered in Colorado, United States at PO Box 772, Wheat Ridge, CO 80034.

We operate the website https://www.foothillscommunitychoir.org (the “Site”), as well as any other related products and services that refer or link to these legal terms (collectively, the “Services”).

Foothills Community Choir (FCC) is a non-audition chorus in Denver, Colorado with the goal of community enrichment. The Choir works to create an environment of joy, laughter, and fun while maintaining the credo of respect and inclusiveness. FCC strives to develop choral excellence within a supportive and nurturing community environment.

These Terms & Conditions (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Wheat Ridge Community Chorale, concerning your access to and use of the Services. By accessing or using this Site, registering as a member, or participating in our activities online, you agree to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on the Services from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these Terms, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms to stay informed of updates.

All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Services. Parents/guardians are responsible for their child’s use of the Site and are advised to supervise minors’ participation in all choir activities and online interactions.


1. ELIGIBILITY AND MEMBERSHIP

The public-facing areas of this Site are open to all visitors. Certain features, including our membership portal, member directory, internal resources, and discussion forums, are restricted to registered choir members.

To register as a member, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and agree to comply with these Terms; (4) you are not a minor in the jurisdiction in which you reside, or if a minor, you have received parental permission to use the Services; (5) you will not access the Services through automated or non-human means; (6) you will not use the Services for any illegal or unauthorized purpose; and (7) your use of the Services will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Services.

You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.


2. ACCEPTABLE USE OF SERVICES

You agree not to misuse the Site or Services, including but not limited to:

  • Uploading or posting unlawful, harmful, defamatory, obscene, bullying, abusive, discriminatory, threatening, sexually explicit, false, inaccurate, deceitful, or misleading content
  • Attempting to gain unauthorized access to restricted areas or other users’ accounts
  • Using the Site in a way that disrupts choir operations or other users’ experience
  • Systematically retrieving data or other content from the Services to create or compile databases without written permission
  • Circumventing, disabling, or interfering with security-related features
  • Using any information obtained from the Services to harass, abuse, or harm another person
  • Making improper use of our support services or submitting false reports
  • Engaging in any automated use of the system, such as using scripts or data mining tools
  • Attempting to impersonate another user or person
  • Interfering with, disrupting, or creating an undue burden on the Services
  • Using the Services for any revenue-generating endeavor or commercial enterprise without our express consent
  • Violating any applicable laws or regulations

We reserve the right to suspend or terminate access for violations of these Terms.


3. MEMBERSHIP PORTAL AND COMMUNITY FORUM

Our membership portal includes a member directory, internal resources, and discussion forums designed to enhance our choir community. Please note:

Forum Participation: Members may post content in the forum, and while we monitor and may remove posts at our discretion, we are not responsible for user-generated content. Because forum posts may generate email notifications to members, deleted posts may still appear in member inboxes.

Content Standards: When you create or make available any contributions to our forums or other interactive features, you represent and warrant that:

  • Your contributions are not false, inaccurate, or misleading
  • You have the necessary rights and permissions to share such content
  • Your contributions do not violate the privacy or publicity rights of any third party
  • Your contributions are not obscene, defamatory, harassing, or otherwise objectionable
  • Your contributions do not violate any applicable laws or our community standards

Community Guidelines: We strive to maintain a respectful and inclusive environment. Content that ridicules, mocks, disparages, intimidates, or abuses others, or that includes offensive comments connected to race, national origin, gender, sexual preference, or physical handicap, will not be tolerated.

Liability Limitation: Foothills Community Choir is not liable for any harm, offense, or consequences resulting from user-submitted content or interactions between members.


4. INTELLECTUAL PROPERTY RIGHTS

Our Content: We are the owner or licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services (collectively, the “Content”), as well as the trademarks, service marks, and logos contained therein.

All content on this Site, except user-generated forum posts, is the property of Foothills Community Choir or its licensors. You may not reproduce, distribute, or create derivative works without our written consent.

Your Use: Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable license to access the Services and download or print portions of the Content for your personal, non-commercial use in connection with your choir membership.

User Contributions: By posting content to our forums or other interactive areas, you grant us a non-exclusive, royalty-free, worldwide license to use, copy, reproduce, distribute, and display such content in connection with operating the Services. However, you retain ownership of your contributions, and we will not use your content for commercial purposes without your additional consent.

Submissions: Any feedback, suggestions, or ideas you provide about the Services become our property and may be used without acknowledgment or compensation to you.


5. DONATIONS AND PAYMENTS

Donations made through this Site are processed via secure third-party providers including PayPal, Zeffy, Venmo, and Zelle. We also accept cash and check payments. By making a donation or payment, you agree to the respective terms and policies of these payment providers.

You agree to provide current, complete, and accurate purchase and account information for all transactions. Sales tax will be added to purchases as required by law. We may change prices at any time, and all payments shall be in US dollars.

These Terms and your use of the Services are governed by the laws of the State of Colorado, without regard to conflict of law principles.

Informal Resolution: Before pursuing formal legal action, we encourage you to contact us directly to seek a resolution.

Jurisdiction: Any disputes that cannot be resolved informally shall be resolved in the state and federal courts located in Denver, Colorado, and you consent to the jurisdiction of such courts.

By using the Services, you consent to receive electronic communications from us, including emails, text messages (where applicable), and notices posted on the Site.
